Discount Online Fitness LLC ("DOF", "we", "us") is a Texas limited liability company selling pre-owned commercial fitness equipment. Part A below governs your use of this website. Part B is our Terms and Conditions of Sale — the same terms that print on every DOF quote — published here so you can read them before you buy.

Part A — Using This Website

Information only

The content on this site — specifications, condition grading, availability, and pricing — is given in good faith and can change without notice. Photos are of the specific unit or representative of the model and condition tier as noted on the listing. Do not treat anything on this site as a binding offer; a quote is not final until we confirm it, and a sale is not final until payment is received as described in Part B.

Third-party trademarks

Manufacturer and product names, logos, and trademarks referred to on this site belong to their respective owners and are used only to identify the equipment we sell and service. Their use implies no endorsement of DOF by those owners and no affiliation beyond the reseller relationship we hold.

Website disclaimer of warranties

Acceptance, and who may use this site

By accessing discountonlinefitness.com you accept these terms. This site is not directed at children and is not intended for anyone under 13. Where you use the site on behalf of a business, you confirm you are authorized to accept these terms for it.

Our content, and what you may do with it

The text, photography, layout, page design, logos, and arrangement of this site are owned by DOF or used under license, and are protected by copyright and trademark law. You may view the site and print or download pages for the ordinary purpose of evaluating or purchasing our products. You may not copy, republish, scrape, mine, resell, or use our content to train a model, or use our name or logo to imply endorsement, without our written permission.

Acceptable use

Do not attempt to gain unauthorized access to the site or anything connected to it, probe or test its security, introduce malicious code, place disproportionate load on it, misrepresent who you are, or use it for any unlawful purpose. We may restrict access where any of that occurs.

Links to other sites

Nothing is sold or paid for on this site: a listing is an invitation to request a quote, and any sale is completed on the quote we issue and accept. Where we link to a site we do not run, that site is under its own terms — we do not control it and are not responsible for its content or its handling of your information. What we do with information you send us through this site is set out in our Privacy Policy, which forms part of these terms.

Availability, and changes to the site

We may change, suspend, or withdraw any part of this site at any time without notice. Content may be updated or removed as inventory, pricing, and availability change.

Electronic communications

When you contact us electronically or submit a request form, you consent to receiving communications from us electronically, and agree that electronic communications satisfy any legal requirement that a communication be in writing.

Time limit on website claims

Any claim arising out of or relating to this website or to Part A must be brought within one (1) year after the claim arose, or it is permanently barred, except where a longer period is required by law that cannot be shortened by agreement. This limit applies to Part A only; claims relating to a purchase are governed by Part B.

Part B — Terms and Conditions of Sale

The accepted proposal together with these Terms and Conditions of Sale (the "Agreement") is the entire and exclusive agreement between Discount Online Fitness, LLC ("DOF"), and the buyer named on the proposal ("Buyer"), and supersedes all prior discussions, representations, and agreements. It may not be supplemented or modified by course of dealing, course of performance, or trade usage. No sales representative or agent may alter these terms; any change must be in writing signed by a corporate officer of DOF. DOF may correct clerical, typographical, or mathematical errors at any time. Where you have a signed proposal, the version of these terms printed on that proposal controls over this page.

Buyer's purchase order

Buyer may issue a purchase order for convenience only. Any term in Buyer's purchase order or other form that is additional to or inconsistent with this Agreement is rejected and has no effect, even if DOF accepts or fills the order. For any of Buyer's terms to apply, Buyer must deliver them in writing and obtain a DOF corporate officer's written agreement before this Agreement is executed. Buyer's execution constitutes acceptance of all of these terms.

Prices, taxes, and fees

Prices are valid thirty (30) days from the proposal date unless sooner executed, and are exclusive of all sales, use, excise, and similar taxes. We charge sales tax in states where we have a tax nexus, currently Texas; any such tax will be separately stated on the proposal or invoice and added to the price as a pass-through charge, unless Buyer furnishes a valid resale or exemption certificate. Buyer is also responsible for freight, forwarding, brokerage, duty, export-license, and similar charges.

Payment

Unless the proposal states otherwise, terms are fifty percent (50%) down and fifty percent (50%) due on delivery. DOF must receive the down payment before any product is ordered; the balance is due on or before shipment or installation; and all shipped orders must be paid in full before shipment. Alternate or net terms apply only if approved through DOF's credit process and stated in writing. Amounts not paid when due bear interest at 1.5% per month (or the highest lawful rate, if lower) until paid. We accept credit and debit cards, checks, ACH transfers, and wire transfers; we do not accept cryptocurrency.

Payment security; wire fraud; verification of instructions

Buyer is solely responsible for verifying the authenticity of all payment and wire-transfer instructions before remitting any funds. DOF will not change its payment or wire instructions by email alone. Buyer must independently verify any payment, wire, or account instructions — and any purported change to them — by calling a known DOF telephone number taken from a prior invoice or our official records, and never a number contained in the email or instruction in question, before sending funds. Payment made to any account other than DOF's verified account does not discharge Buyer's payment obligation.

Retention of title; security interest

Title to all products remains with DOF until DOF receives payment in full. To secure payment and performance of all obligations owed, Buyer grants DOF a purchase-money security interest under the Uniform Commercial Code in all products sold and their proceeds, and this Agreement is a security agreement. Buyer authorizes DOF to file financing statements and continuations or amendments to perfect that interest. Upon any payment default, DOF may, without breach of the peace and upon reasonable notice, enter Buyer's premises during normal business hours to take and remove any products not paid for in full.

Shipment, delivery, and risk of loss

References on this site to "nationwide shipping" mean shipping availability: we arrange commercial freight to all 48 contiguous states. They are not an offer of free or flat-rate shipping. Freight is charged per order, and any shipping figure given before your quote is confirmed is an estimate only — your confirmed quote states the actual delivered price before you pay anything.

This equipment is heavy and generally ships pre-assembled, so shipping is quoted per order against your real delivery address. Standard delivery is curbside. Inside or white-glove delivery may be available in select service areas for an additional fee — ask your sales representative whether it is offered to your location and what it costs. We sell throughout the United States and internationally; outside the United States, you are responsible for arranging your own freight carrier to pick up from our dock, and risk of loss passes to you at that pickup. Freight insurance is available for purchase as an add-on — ask when you request your quote.

Shipment is F.O.B. our or the manufacturer's warehouse. Except where DOF delivers with its own personnel, risk of loss passes to Buyer when products are delivered to the carrier or picked up by or for Buyer. You are responsible for inspecting all freight at the time of delivery and noting any damage directly with the carrier before signing. Where Buyer arranges its own carrier or pickup, Buyer must file any freight-loss or damage claim directly with the carrier — freight carriers enforce their own strict damage-claim policies, not ours, and damage not noted at delivery may become your responsibility. Where DOF arranges the carrier, we will, as an accommodation to Buyer, help file and pursue a freight-loss or damage claim on Buyer's behalf, though the carrier's policy still governs the outcome. Delivery dates are estimates only; we are not liable for loss arising from delay.

Custom or special-order products

Custom or special-order products require non-refundable 100% payment and cannot be cancelled, returned, rescheduled, or refused once ordered. An executed Agreement that includes a custom or special-order product obligates Buyer to take and pay for delivery.

Returns, cancellation, and restocking

Custom and special-order products may not be returned or cancelled. Standard stock equipment may be returned only with our prior written authorization, at Buyer's expense and risk, and is subject to a 25% restocking charge. After execution, any cancellation is subject to a 25% cancellation fee of the proposal total. Buyer is responsible for all freight and insurance costs on refused shipments. Used equipment sales are otherwise final — see Warranty by Condition Tier below for the only exception.

Site readiness and storage

Where delivery requires site readiness — for example, adequate space, flooring, structural capacity, or a dedicated electrical circuit for powered equipment — Buyer is responsible for confirming it before delivery. Product held at Buyer's request more than ten (10) days after the scheduled delivery date is subject to a storage fee; product held more than thirty (30) days is also subject to a 10% restocking fee. We are not liable for damage to driveways, floors, walls, doorways, or other property along the delivery path, including from delivery vehicles; Buyer must disclose conditions likely to cause such damage before delivery and is responsible for any resulting damage.

Warranty; manufacturer warranty

Where DOF sells new equipment, it carries only the manufacturer's own limited warranty, which we pass through to Buyer; we do not independently warrant new equipment. Used, refurbished, and remanufactured products are warranted only as set forth below. Except as expressly stated, products are sold "as is," and DOF disclaims all other warranties, express or implied, including merchantability and fitness for a particular purpose.

Warranty by condition tier

Every listing states its condition tier, and warranty coverage depends entirely on which tier you buy:

  • As-Is — sold with no service, repair, or warranty of any kind. You accept the equipment in its present condition and at your own risk.
  • Cleaned & Serviced — the equipment is deep-cleaned and its moving and wear components are inspected, lubricated, cleaned, or replaced as needed. Cosmetic condition is not addressed: no repainting, touch-up, or cosmetic repair is included, and the equipment may show blemishes, wear, or scratches. Includes a 30-day parts-and-labor warranty.
  • Remanufactured — the equipment is repainted, worn components are replaced with new parts, and the machine is made mechanically sound and calibrated. It is our highest condition standard for pre-owned equipment. Includes a 90-day parts-and-labor warranty.

Except for the warranty expressly stated for the applicable tier, all used equipment is sold AS IS. All used-equipment sales are final, and used products may not be returned except as required by the applicable condition warranty. Model, age, hours, and specifications stated for used equipment are approximate and not warranted. Extended or additional warranty coverage may be available for purchase if you want more protection than the applicable tier provides.

Warranty remedy

If a covered defect arises during the warranty period, we will repair it. If we cannot repair it, we will replace it with equipment of similar quality or refund your purchase price, at our election. Because this is used equipment — more like a used car than a factory product — an identical replacement unit may not exist, and any comparable replacement is not guaranteed to match the original exactly. Used equipment is expected to show normal cosmetic wear; our warranty covers function, not cosmetic condition.

A manufacturer's original warranty rarely continues on equipment we sell as used; it may in limited cases where the equipment is roughly five years old or newer, and manufacturer warranty terms are also commonly affected by where the equipment is installed and how it is used.

Warehouse pickup voids the warranty

If you elect to pick up equipment from our warehouse yourself, it carries no warranty, regardless of condition tier, and is taken at your own risk. By taking pickup, you acknowledge that you inspected the equipment, found it in good working order, and agree that DOF is not liable for its condition, functionality, or any damage or injury occurring in transport or use once it leaves our warehouse. Buyers are offered delivery with the applicable warranty and, by choosing pickup instead, decline it.

Trade-ins, and selling or consigning equipment to us

We accept trade-ins toward a purchase. Trade-in value is an estimate until we have inspected the equipment and is not guaranteed until confirmed in writing on your quote or order. Separately from a trade-in, we also buy equipment outright for cash and work on consignment for equipment we sell on your behalf. Terms for an outright purchase or a consignment arrangement, including any consignment commission, are set out in writing before we take the equipment, not on this page.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOF'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THIS AGREEMENT WILL NOT EXCEED THE PRICE PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. DOF WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOSS OF USE, OR PERSONAL INJURY, EVEN IF ADVISED OF THE POSSIBILITY. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Buyer indemnity

Buyer will indemnify, defend, and hold harmless DOF from third-party claims for bodily injury or property damage to the extent arising from Buyer's use, operation, storage, or supervision of the products, Buyer's site or premises conditions, or Buyer's negligence or willful misconduct, except to the extent caused by DOF's own negligence.

Force majeure

We are not liable for delay or failure to perform caused by anything beyond our reasonable control, including acts of God, labor disputes, supplier or carrier failures, transportation failures, severe weather, or government action. Delivery dates are estimates only, and performance resumes as soon as practicable after the cause ceases.

Default and bankruptcy

In addition to our other remedies, upon Buyer's bankruptcy, insolvency, assignment for the benefit of creditors, or receivership, we may cancel any unfilled portion of Buyer's order without liability and accelerate all amounts owed.

Governing law and venue

This Agreement is governed by the laws of the State of Texas, without regard to its conflict of laws rules. The exclusive venue for any dispute is the state or federal courts located in Tarrant County, Texas. The prevailing party in any dispute is entitled to its costs and reasonable attorneys' fees.

Acceptance, authority, agents and owners

By signing a DOF proposal, Buyer accepts this Agreement, which binds Buyer upon Buyer's signature whether or not countersigned by DOF; we may also accept by performing. The signer represents it is authorized to bind Buyer and any principal for whom it signs. Anyone signing as agent, property manager, or representative of an owner is jointly and severally liable with that owner for all obligations. This Agreement binds the parties' successors and assigns, and no sale or transfer of the property or change in owner, management company, or agent reduces or discharges Buyer's obligations.

General

No waiver is effective unless in writing signed by the waiving party. If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions stay in full force. Buyer may not assign this Agreement without our written consent; we may assign freely. This Agreement, together with our Privacy Policy and any signed proposal, is the entire agreement between us on their subject matter. We may update these terms; the effective date at the top of this page changes when we do.

Common Questions

Do I get a warranty on used equipment?
It depends on the condition tier. As-Is equipment carries no warranty and is sold at its stated condition. Cleaned & Serviced includes a 30-day parts-and-labor warranty. Remanufactured includes a 90-day parts-and-labor warranty. Full terms are in our Terms and Conditions.
What happens if my equipment needs a warranty repair?
We'll repair it. If we can't, we'll replace it with equipment of similar quality or refund your purchase price, at our discretion. Because this is used equipment — more like a used car than a factory product — an identical replacement may not exist, and a comparable one isn't guaranteed to match the original exactly.
Does picking it up myself affect the warranty?
Yes — equipment you pick up from our warehouse yourself carries no warranty, regardless of condition tier. By taking pickup you're confirming you inspected it and accepted it in its current condition. Warranty coverage applies only to equipment we deliver. See our Terms and Conditions for the full policy.
Does the manufacturer's original warranty carry over?
Rarely, though it's possible on equipment under about five years old — manufacturer terms are also affected by where it's installed and how it's used. We separately offer extended and additional warranty coverage for purchase if you want more protection.
Can I return equipment if I change my mind?
No — used equipment sales are final except for a defect covered by your warranty tier. These are used, not new, machines, so expect normal cosmetic wear and the occasional blemish; our warranty covers function, not cosmetics.
Do you charge sales tax?
Yes, in states where we have a tax nexus — currently Texas. Dealer and resale accounts with a valid resale or exemption certificate on file are taxed accordingly.
Do you ship outside the United States?
We sell worldwide, but international orders are picked up by your own freight carrier from our dock — we don't arrange international freight ourselves. Domestic U.S. orders ship with freight we arrange.
What if my equipment arrives damaged?
Inspect it and note any damage with the carrier at the time of delivery, before you sign — freight carriers enforce strict damage-claim policies, not ours, and damage not noted at delivery may become your responsibility. Freight insurance is available for purchase as an add-on if you want extra protection.
Can I sell my equipment to you outright, or on consignment, instead of trading it in?
Yes to both — we buy equipment outright for cash, and also work on consignment. That's separate from a trade-in credited toward a purchase; ask when you contact us which option fits what you're after.
